Ukraine Shifts Course on Gambling Regulation

Ukraine has taken significant steps in its gambling regulation by disbanding the Commission for the Regulation of Gambling and Lotteries (KRAIL). This decision, backed by President Volodymyr Zelenskyy’s approval of Law No. 9256-d, sets the foundation for a new regulatory framework. The government plans to establish a central authority by April, aiming to streamline oversight and address the challenges in the country’s gambling industry.

New Regulatory Framework

The new regulatory body will assume a broader mandate. It will oversee live monitoring systems, enforce player identification protocols, and implement measures to reduce gambling-related harm. The government will particularly focus on limiting access to unlicensed gambling sites and tackling addiction. Additionally, operators will face stricter advertising rules. Promotional activities will be severely reduced, and advertising will only be permitted in specific contexts, such as late-night TV slots or on platforms targeting older audiences.

Centralized Oversight

This restructuring aims to centralize governance and improve oversight. By dissolving KRAIL, the government positions itself as the primary authority over gambling and lotteries, seeking to enhance the effectiveness of regulation.

KRAIL’s Controversial Tenure

KRAIL’s dissolution follows a turbulent period marked by allegations of corruption and mismanagement. Established in 2020 after Ukraine legalized gambling, the commission quickly became embroiled in controversies.

In 2021, KRAIL official Yehven Hetman was arrested for accepting bribes in exchange for issuing gambling licenses without due diligence. Investigations revealed that some licenses were approved irregularly, raising concerns about the integrity of the regulatory process.

More recently, KRAIL’s head, Ivan Rudyi, was arrested for allegedly aiding the operation of a Russian-affiliated online casino. This situation raised national security concerns, particularly over the potential breach of personal data, including sensitive information about Ukrainian military personnel.

The Need for Reform

The issues surrounding KRAIL highlighted systemic weaknesses and demonstrated the need for reform. President Zelenskyy’s decision to dissolve the commission reflects a commitment to creating a more transparent and reliable regulatory framework. This move is part of a broader effort to restore trust in the system.
