Michigan Judge Orders Kalshi Ban Amid Prediction Markets Fight

Michigan has become the second state to force Kalshi off its home turf, at least for now. Ingham County Circuit Judge Rosemarie Aquilina issued a temporary restraining order on June 29, and the Kalshi Michigan ban stops the company from taking new deposits, opening accounts, advertising, or launching similar products anywhere in the state. It’s the first real courtroom win for Attorney General Dana Nessel since she filed suit against the prediction market platform back in March.

The order runs through July 13, with no hearing date set yet. Kalshi also has to route its geolocation checks through a state-licensed provider, and skipping that step carries a steep price. Failing to comply could cost the company $120,000 a day.

Why the Judge Sided With Michigan

Aquilina’s ruling leaned on more than just licensing technicalities. She pointed to real harm: exploitation of vulnerable users, lost revenue for schools, tribes, and first responders, and an unfair edge over Michigan’s licensed sportsbooks, which have to follow far stricter rules.

One detail stands out. Kalshi lets users sign up at 18, but Michigan’s regulated sportsbooks require players to be 21. That four-year gap gave Nessel’s office a concrete example of how Kalshi sidesteps protections that licensed operators can’t avoid. For a judge weighing consumer harm, that kind of specific, checkable fact carries more weight than abstract arguments about market structure.

The state’s broader case leans on its Lawful Sports Betting Act, arguing that Kalshi’s event contracts function as sports bets no matter what the company calls them. Nessel’s office has framed the fight as one of fairness, licensed Michigan operators pay fees, submit to audits, and fund public programs, while Kalshi has operated without any of that.

A Losing Streak in State Court

This isn’t Kalshi’s first setback in Michigan. In June, the company tried to move Nessel’s lawsuit into federal court, betting that a federal venue would favor its argument that its contracts fall under Commodity Futures Trading Commission oversight rather than state gambling law. A federal judge rejected that move and sent the case back to state court, where Michigan’s gambling statutes carry more force. The Kalshi Michigan ban followed less than a month later, so the company has now lost on both the procedural front and the substantive one in the same case.

Michigan joins Nevada as the second state with a court-ordered halt against Kalshi, though the two rulings came from different legal angles. A similar injunction in Massachusetts remains in effect but is currently paused while an appeal plays out. Taken together, the pattern shows state courts growing more comfortable treating prediction markets as gambling products rather than the financial instruments Kalshi says they are.

What Comes Next

Kalshi has said it will comply with the order while continuing to fight it, and the company still leans on its core argument: federal law through the CFTC should preempt state gambling regulation entirely. That argument hasn’t landed in Michigan yet, but the case is far from over, and no hearing date means the current restrictions could stretch on for weeks.

The stakes reach beyond one company’s Michigan business. Kalshi was recently valued at $22 billion, and the outcome here could shape how other states approach prediction markets going forward. If Michigan’s order holds up past July 13, it gives other attorneys general a tested legal template built around consumer protection rather than jurisdictional arguments alone.
