WHAT SENATE BILL 555 DID

Montana wrote the template that other states have followed since, and it did so with unusually broad language.

THE LAW ITSELF

SB 555 was introduced by Senator Vince Ricci, passed both chambers in April 2025 with minimal amendment, and was signed by Governor Greg Gianforte on 12 May 2025. It took effect on 1 October 2025, amending the Montana Code Annotated to redefine internet gambling so that the term includes online casinos, by whatever name known.

HOW THE LAW CAPTURES ONLINE CASINOS IN MONTANA

The prohibition covers any platform, website or application that knowingly transmits or receives gambling information, allows consumers to place a bet or wager using any form of currency, and makes payouts of any form of currency. That last phrase is what does the work: by refusing to limit itself to money, the statute captures virtual currencies including Sweeps Coins.

• Fines of up to 50,000 dollars per offence
• Prison terms of up to ten years
• Liability reaches anyone who operates or advertises such a platform

IT ALSO CAUGHT PREDICTION MARKETS

Because the language targets unlicensed online wagering generally rather than sweepstakes specifically, SB 555 also covers online prediction markets. Montana effectively closed the whole category in one move.

WHAT HAPPENED TO THE MARKET

The response was faster and more complete than in any state that has banned since. There was no defiance and no test case.

OPERATORS LEFT EARLY

Major brands began IP-blocking Montana users over the summer of 2025, well before the October deadline. Chumba Casino, LuckyLand Slots, McLuck, WOW Vegas, Pulsz, NoLimitCoins and Funrize had all withdrawn by the time the law took effect. Registering from a Montana location is now rejected across the sector.

WHY ONLINE CASINOS IN MONTANA DID NOT FIGHT THE BAN

Felony exposure with a ten-year maximum changes the calculation entirely. In states where enforcement rested on a regulator letter and an untested reading of old statute, operators could afford to wait and see. A criminal statute naming the conduct removes that option, particularly when advertising the platform carries the same exposure.

THE INDUSTRY RESPONSE

The Social and Promotional Games Association criticised SB 555 as overly broad, arguing the definition could capture ordinary marketing promotions run by hotels, airlines and retailers, and describing it as a law so broadly written it fails to name what it bans. Montana lawmakers did not amend the bill in response, and the association also noted that Arkansas, Maryland, Mississippi and Florida had all rejected similar proposals that same year.

THE PRECEDENT

Montana proved the approach worked. Connecticut, Nevada, New York, New Jersey, California, Indiana, Maine, Tennessee, Oklahoma and Louisiana have all since enacted their own prohibitions, several borrowing the same broad currency language.

WHAT IS STILL LEGAL IN MONTANA

Montana has a small and unusual regulated gambling market, and SB 555 left it untouched while closing everything online.

THE KIOSK MODEL

Montana is one of very few states where sports betting runs through physical kiosks operated under the state lottery rather than through mobile apps. There is no statewide mobile sportsbook. That restrictive starting point helps explain why the legislature had little hesitation about closing online casino-style play as well.

NO COMMERCIAL CASINOS

Montana has no commercial casino industry of the kind found in Nevada or Mississippi. Gambling is spread across tribal properties, licensed taverns with video gaming machines, and the lottery. There was no land-based operator lobbying for an online product, and none lobbying against one either.

Montana holds a regular legislative session only in odd-numbered years, so the next scheduled opportunity to revisit any of this is 2027. That alone slows any change considerably.

THE OUTLOOK FOR ONLINE CASINOS IN MONTANA

Montana did not ban sweepstakes casinos in order to protect a regulated online market, because it has none. It banned them because it treats unlicensed internet gambling as something to be closed rather than channelled. That posture makes licensed online casinos an unlikely prospect in the near term.

OFFSHORE SITES AND PLAYER PROTECTION

The most important practical consequence of the Montana ban is the same one seen in every prohibition state: it removed the accountable option and left the least accountable one reachable.

PLAYERS ARE NOT THE TARGET

SB 555 is aimed at operators and at those who advertise them. No Montana resident has been prosecuted for playing at a sweepstakes casino, and the felony exposure attaches to running or promoting a platform rather than to using one. The practical consequence for a player was losing account access and any unredeemed balance when the operators withdrew.

WHY OFFSHORE IS WORSE

Offshore casino sites were already unlawful to offer to Montana residents and remain reachable. They are not licensed by any Montana authority, not audited, and not answerable to anyone here. A refused withdrawal or a closed account with a balance in it has no route to resolution.

There is no lawful way to play real money casino games online from Montana, and since October 2025 there is no sweepstakes route either. What the state does allow is narrow but genuinely regulated.

SPORTS BET MONTANA

Sports betting runs through kiosks operated under the Montana Lottery at licensed locations across the state. It is not a mobile product, so it requires visiting a venue, but it is state-regulated with real consumer protections.

TRIBAL CASINOS

Tribal properties operate in person under compact and offer slots and table games. Since the ban these are the main route to casino gaming in Montana.

THE MONTANA LOTTERY

Draw games and scratch tickets remain available, and the lottery also administers the sports betting kiosks.

FREE-PLAY SOCIAL CASINOS
