Legislation to raise the rate to 25% has been proposed but not passed.

Age and location rules

Players must be 21 or over. Licensed operators run identity verification at sign-up and geolocation checks during play, so accounts only work inside state lines. Residency is not the test: a visitor physically in West Virginia can play, a resident travelling elsewhere cannot.
