WHAT SENATE BILL 5935A DID

New York did not creep toward a ban. It passed one by almost unanimous margins and then sat on it for six months before signing.

THE LAW

S5935A, sponsored by Senator Joseph Addabbo Jr., chair of the Racing, Wagering and Gaming Committee, adds Section 912 to the Racing, Pari-Mutuel Wagering and Breeding Law. It makes it unlawful to operate or promote an online sweepstakes game in New York, targeting the dual-currency structure specifically: a purchasable coin with no cash value paired with a promotional coin that can be redeemed for money or prizes.

THE VOTE AND THE DELAY

The Senate passed it 57 to 2 and the Assembly 141 to 0 in June 2025. The bill was not delivered to the Governor until early December, and she signed it on 5 December 2025. It became law and took effect the same day.

THE PENALTIES

Violations carry fines of 10,000 to 100,000 dollars each, enforced by the New York State Gaming Commission and the Attorney General, along with loss of any gaming licence or future eligibility to hold one. The penalties are civil rather than criminal, but the licensing consequence is severe for any company with regulated ambitions in the state.

THE ATTORNEY GENERAL GOT THERE FIRST

By the time the ban was signed the market had already gone, and that is the part of the New York story worth understanding.

THE JUNE 2025 LETTERS

On 6 June 2025 Attorney General Letitia James announced cease-and-desist letters to 26 sweepstakes operators, citing New York Penal Law Article 225 and Article I Section 9 of the State Constitution. Every one of them agreed to stop selling Sweeps Coins to New York players. Chumba and Fliff were among those named.

That outcome is unusual. In Illinois, 63 of 65 operators ignored near-identical letters. In New York all 26 complied, and the difference was that a ban had already passed both chambers of the legislature five days later and was waiting on the Governor desk.

WHAT THE SIGNATURE ADDED

The December signature converted a voluntary retreat into a legal prohibition with penalties and named categories of liability. Platforms still serving New York on the day, including McLuck, Pulsz, Crown Coins and ClubWPT Gold, lost access immediately.

THE INDUSTRY CASE THAT FAILED

The Social Gaming Leadership Alliance commissioned research putting New York sweepstakes sales above 760 million dollars in the previous year, more than 250 million in net revenue and up to 230 million in wider economic impact. It argued lawmakers had misunderstood the model. With an Assembly vote of 141 to 0, the argument did not land.

WHAT IS STILL LEGAL IN NEW YORK

New York has one of the more fragmented gambling frameworks in the country: some things are fully licensed and regulated, others are prohibited outright, and online casino play sits firmly in the second group.

THE REGULATOR

The New York State Gaming Commission licenses and audits the casinos, sports betting operators, lottery and racing, and shares enforcement of the sweepstakes ban with the Attorney General office.

SPORTS BETTING WITHOUT IGAMING

New York runs one of the biggest legal mobile sports betting markets in the United States, launched in 2022 and taxed heavily. Online casino games have not followed. Bills to authorise iGaming have been introduced repeatedly, and the tax rate that makes sports betting lucrative for the state is part of why the casino industry has resisted a similar structure for online slots.

WHY ONLINE CASINOS IN NEW YORK REMAIN UNLICENSED

Banning sweepstakes did not create a legal alternative, and the reasons are structural rather than moral.

WHY DOWNSTATE LICENCES DELAYED ONLINE CASINOS IN NEW YORK

New York has spent recent years awarding lucrative downstate casino licences. Operators bidding billions for physical properties have little interest in an online product that could compete with them before the doors open, and that dynamic has shaped the legislative agenda.

THE VOTE TELLS YOU SOMETHING

An Assembly vote of 141 to 0 against sweepstakes is not a narrow policy dispute. New York legislators were prepared to close an unlicensed market decisively while showing no comparable appetite to open a licensed one. That combination suggests the near-term picture is prohibition without replacement.

OFFSHORE SITES AND PLAYER PROTECTION

As in every prohibition state, the ban removed the accountable option and left the least accountable one reachable.

PLAYERS ARE NOT LIABLE

This is worth stating plainly. Both S5935A and Penal Law Article 225 target operators, payment processors, suppliers and affiliates. Individual users in New York face no criminal liability for having played, and nobody has been pursued for it. What players lost was access and, in some cases, unredeemed balances when platforms withdrew without notice.

WHY OFFSHORE IS WORSE

Offshore casino sites still accept New York players and were already unlawful to offer here. They carry none of the accountability that even an unlicensed United States sweepstakes operator had: no corporate presence, no published terms worth much, and no realistic route to resolution.

• Payment processing that can fail without warning
• No New York authority to complain to, unlike the licensed sportsbooks

LEGAL ALTERNATIVES FOR NY ONLINE CASINOS

There is no lawful online casino option in New York, but unlike most prohibition states there is a large regulated online product alongside it.

LICENSED MOBILE SPORTS BETTING

Legal since 2022 and one of the largest markets in the country, with licensed operators regulated by the Gaming Commission. Audited outcomes, enforced self-exclusion and a formal complaints route, none of which a sweepstakes platform offered.

COMMERCIAL AND TRIBAL CASINOS

Licensed casinos operate across the state, with downstate licences being awarded. Since December 2025 these are the regulated route to slots and table games for New York players.

THE NEW YORK LOTTERY

Draw games, scratch tickets and online subscription sales all remain available and state-run.

GOLD COIN SOCIAL CASINOS

The ban targets the redemption model, not casino-style games as such. Social casinos offering Gold Coin play with no cash or prize redemption remain lawful in New York, which is the compliant option if you want the games rather than the prizes.

WHAT NOT TO DO
