Kalshi Nevada Ban: Court Blocks Prediction Markets

Kalshi is temporarily banned in Nevada after a state court issued a 14-day restraining order blocking the prediction market platform from offering event-based contracts in the state. The order covers bets on sports, elections, and entertainment outcomes, and it marks a sharp escalation in the legal battle between Kalshi and the Nevada Gaming Control Board (NGCB). For a company that operates in one of the most gambling-saturated states in the country, the Kalshi Nevada ban is a significant blow.

What Led to the Kalshi Nevada Ban

The conflict between Kalshi and Nevada regulators is not new. The NGCB issued a cease-and-desist order against Kalshi back in March 2025, accusing the platform of providing unlicensed gambling services. Kalshi pushed back by filing a lawsuit against the NGCB in federal court, arguing that its prediction markets fall under federal jurisdiction through the Commodity Futures Trading Commission (CFTC). That federal argument hasn’t landed well in state proceedings.

Nevada’s First Judicial District Court sided with the NGCB, granting the temporary restraining order and effectively shutting down Kalshi’s operations in the state while the broader legal case plays out. The NGCB is also pushing for a permanent injunction, meaning this short-term block could become indefinite.

At the heart of the dispute is a fundamental disagreement about what Kalshi’s product actually is. The NGCB argues that its prediction markets function like sports betting, and that Kalshi lacks the consumer protections required of licensed sportsbooks under Nevada law. Kalshi insists it operates legally under federal oversight, but that argument holds little weight in a state court focused on enforcing its own gaming regulations.

Nevada Isn’t the Only Problem

The Nevada ruling landed in the same week that Arizona’s Attorney General filed criminal charges against Kalshi for allegedly facilitating illegal gambling in that state. Two serious legal actions in the same week paint a difficult picture for a platform that has publicly stated its operations are legal across all 50 states.

NGCB Chairman Mike Dreitzer addressed that claim directly, stating it is clearly not true. His position reflects a growing resistance among state regulators who see prediction markets as a category that federal oversight alone cannot legitimately cover.

The legal pressure is not limited to Kalshi either. Tribal gaming groups in Oklahoma have also pushed back against prediction markets. The Kalshi Nevada ban, combined with the Arizona charges, puts the entire prediction market sector under a sharper spotlight.

What This Means for Prediction Markets

Prediction markets have grown rapidly, attracting users who want to bet real money on real-world outcomes without going through a licensed sportsbook. Platforms like Kalshi and Polymarket have built significant audiences, with Polymarket recently signing a partnership deal with Major League Baseball. But that growth is now running headfirst into state gambling law.

Nevada’s position is clear: if a product walks like sports betting and pays out like sports betting, it falls under state gambling regulations regardless of how it is classified at the federal level. The CFTC provides federal oversight for Kalshi’s futures contracts, but that does not automatically exempt the platform from state licensing requirements. Nevada wants that distinction enforced.

The outcome of the court proceedings will matter well beyond Nevada’s borders. Other states are watching. If Nevada secures its permanent injunction, it gives other regulators a clear legal framework to follow. The Kalshi Nevada ban could become a template.

A Turning Point for the Sector

Kalshi now faces a difficult path forward. It must fight a temporary ban in Nevada, answer criminal charges in Arizona, and defend its operating model in a legal environment that is becoming less friendly by the month. Expanding internationally may offer some breathing room, as Kalshi has recently partnered with Brazilian investment firm XP Inc. to enter the Brazilian market.

But the US legal situation is the one that defines the company’s near-term future. Prediction markets sit in a genuinely contested regulatory space, and courts are starting to draw lines. Whether Kalshi can convince judges that its model deserves separate treatment from traditional sports betting remains to be seen. Right now, Nevada’s answer is no.
