PRIVATE LITIGATION INSTEAD

Where the state has stayed quiet, private plaintiffs have not. A class action was filed in January 2025 against VGW Holdings, the operator behind Chumba Casino and Global Poker, alleging that the sweepstakes model amounts to illegal gambling. That case is a reminder that the absence of state enforcement does not mean the model is settled law in Massachusetts.

WHAT THIS MEANS IN PRACTICE

The honest description is legal but unaddressed rather than legal and protected. Nothing prohibits these platforms today, and nothing shields them either. A future Attorney General could reach for 940 CMR 30.05 without needing any new legislation at all.

HB 4431 AND THE LEGALISATION QUESTION

The most serious threat to sweepstakes casinos in Massachusetts came bundled with the biggest opportunity for regulated online gaming, and both died together.

WHAT THE BILL WOULD HAVE DONE

House Bill 4431, introduced by Representative David Muradian in 2025, took a two-sided approach: legalise and regulate online casino gaming, and criminalise sweepstakes casinos with penalties reaching 100,000 dollars per violation. Massachusetts would have swapped an unregulated market for a licensed one in a single move.

WHY THE BAN ON ONLINE CASINOS IN MASSACHUSETTS FAILED

The bill died in committee in March 2026, with lawmakers opting to study the issue further rather than vote. The politics were difficult from the start. Muradian is one of roughly thirty Republicans in a legislature where Democrats hold about 84 per cent of the House and 87 per cent of the Senate, and Governor Maura Healey is also a Democrat, so the bill needed cross-party backing it never secured.

Muradian has said he intends to refile for the 2027 to 2028 session. Massachusetts runs a two-year legislative cycle, so the practical effect is that sweepstakes casinos are safe here through 2026 at minimum.
